Dear readers, Filing a new case is the main work of an advocate. Before filing a case we have to understand what are the pre-requisites for filing a case. The case may of mainly two types civil and criminal.  Essential of civil cases: For filing a civil case minimum one person is essential, who can file a suit and is called plaintiff / petitioner. In special type of case like probate, succession etc. one person can file a case against no one. On the other hand for most common civil suit contain at least two parties. Other parties on which against the case is filed called defendant / opposite parties. partition suit, title suit, maintenance, divorce etc. are common example of this type of cases. Origin of Advocates

After the Independence of India, our constitution have come into force on 26 January 1950. In which PART III of our constitution has given right to all citizens of India which is FUNDAMENTAL RIGHTS. In fundamental rights Article 19 says about RIGHT TO FREEDOM. In article 19 (6) defines legal professionals. Article 19 19. Protection of certain rights regarding freedom of speech etc .- (1) All citizens shall have the right- (a) to freedom of speech and expression; (b) to assemble peaceably and without arms; (c) to form associations or unions; (d) to move freely throughout the territory of India ; (e) to reside and settle in any part of the territory of India ; and
